Johannesburg - An 18-year-old man, who was detained and almost deported to Mozambique, because he was considered "too dark" was awarded R90 000 in the Pretoria High Court, the Star newspaper reported on Tuesday.The court heard that South African born Shaun Mhaule, who was 14 at the time (2004), was hysterical when police were about to load him onto a truck in Mpumalanga, "back to his homeland".
The newspaper reported that police insisted Mhaule was "too dark to be a South African" and locked him up for 30 hours with 24 other men.
He also told police that he did not know anyone in Mozambique.
Police would also not take his identity document into consideration, the Star reported.
Mhaule was later released into the custody of his mother and a journalist in Nelspruit.
Judge Willie Seriti said it was clear that Mhaule's arrest and subsequent detention was unlawful and granted him R90 000 in damages.
The damages would be paid out by the Minister of Safety and Security, the newspaper said.

HOW is a person's blackness relevant to the prejudice and sickness that caused him to be locked up in the first place? Yes the cops were more than likely white, so its not black on black racism...its just racism. I have an African friend from Kenya who told me how they can distinguish which country in Africa someone is from by their skin tone...thats crazy. People, People. I am more shocked that alot of ya'll are so surprised. In case you haven't noticed. Anywhere in the world where there is white influence color/race will be an issue. Places that white majority don't rule the problem is usually religious or tribal issues. Considering this is south africa, I am not stunned by the color issue. You also have to understand that the afrikkans rule(a small white sector of south africa which run the south african gov). If the cops were black I question what has happened in their lives to make them hate their own brothers.Hmmm.. yeah it's self-hatred which stems from racism which initiated during the Grecian- Roman period. Before this time, blacks, whites, browns were all ethnically and racially the same. There were no superior or inferior races, everyone was the same. Oh how I wish I could have lived in that era. This may be hard for many of you to understand but their could be a basis for this argument if you consider this fact; the various tribes within Africa do actually have varying physical characteristics such as skin colors, hair textures etc. From light colors to very, very smooth and dark skin colors.
So perhaps, as wild and racist as this incident may seem and probably was; there are differences in the physical appearance of a South African verses a West African.
